This thesis considers the implications of the detention of Australian citizens David Hicks and Mamdouh Habib after 9/11, particularly for citizenship, human rights and access to the rule of law. The thesis draws on the theories of Hannah Arendt and Giorgio Agamben when observing how removal of 'the right to have rights' as Arendt conceptualises it, can lead to deconstitution of the human, civic and social body.
